Nicodemus speaks here as a member of the Sanhedrin, the ruling council, and John reminds readers that he had come to Jesus earlier by night (John 3). The chief priests and Pharisees have just dismissed the temple officers for failing to arrest Jesus and have scorned the crowd as ignorant of the law.
