God is speaking to Moses on Mount Sinai, giving instructions for the tabernacle the Israelites will build in the wilderness. The ark is the gold covered chest described in the preceding verses, and the Testimony means the stone tablets of the covenant, the Ten Commandments given in chapter 20.
